INTELLECTUAL PROPERTY (IP) INFRINGEMENT CLAIMS NOTICE

At MelloHello, we value creativity, originality, and respect for intellectual property. Whether you're a user posting personal content or a business sharing your promotional material, we expect everyone to share only what they have the legal right to use.

This IP Infringement Claims Notice outlines how to report content on the MelloHello App that you believe infringes your intellectual property rights, such as copyrighted material, trademarks, or brand assets. It also explains what happens when a claim is submitted, and how users can respond if they believe the removal was in error.

We take these claims seriously and are committed to acting in accordance with applicable intellectual property laws. However, we are not a legal authority - and it is the responsibility of both the claimant and the content owner to understand and assert their rights properly.

Please note that any notice you submit must be truthful and must be submitted under penalty of perjury. A false notice may give rise to personal liability. You may therefore want to seek the advice of legal counsel before submitting a notice. 

A. COPYRIGHT INFRINGEMENT

Whom you can file a claim regarding a copyright infringement to?

All claims alleging copyright infringement for material that you believe to be residing on our website, should be promptly sent in the form of written notice to our Copyright Agent at admin@mellohello.net.

How can you file a claim regarding a copyright infringement?

Valid claim must be a written communication that includes all the following elements:

• A description of the copyrighted work you believe has been infringed
• A link or description of where the infringing content appears on the App
• A statement that you believe in good faith that the use is unauthorized
• Your contact information (name, address, email, phone number)
• A declaration that the information you provide is accurate and that you are the copyright owner (or authorised to act on their behalf)
• A physical or electronic signature

B. TRADEMARK INFRINGEMENT

If you believe that a user, business listing, group name, or any other content on the MelloHello App is using your registered trademark without permission in a way that could cause confusion or mislead others, you may file a trademark infringement claim with us.

Your notice must include the following information:

• A clear identification of the trademark you believe is being infringed, including your registration number and country of registration
• A description of how the mark is being misused on the MelloHello platform
• A direct link or screenshot showing where the infringing use appears
• Your full legal name, company (if applicable), address, phone number, and email
• A statement that you are the trademark owner or legally authorised to act on the owner’s behalf
• A declaration that the information in your notice is accurate and made in good faith
• Your signature (physical or electronic)

We will review all trademark claims and take appropriate action, which may include removing the content, disabling the account, or requesting more information from the parties involved.

FALSE OR MISLEADING CLAIMS

Please note that submitting a false or misleading IP infringement notice is a serious matter and may have legal consequences. You should only submit a claim if you genuinely believe your intellectual property rights are being infringed. We reserve the right to take appropriate action against individuals who abuse this process.

RESPONSE AND RESOLUTION

Once we receive a complete and valid claim, we will review the matter and may temporarily remove or disable access to the allegedly infringing content while we investigate. We may also notify the user who posted the content and allow them an opportunity to respond or file a counter-notice if they believe the removal was a mistake or misidentification.

REPEAT INFRINGEMENT POLICY

Accounts that are found to repeatedly post or share infringing content may be subject to penalties, including permanent suspension or removal from the MelloHello App, at our sole discretion.
